How to Recover Debt without Going to Court Are you facing a late payment and worried about taking it to court? Once a business takes a debtor to small claims court, youâre likely to get your money back quickly, but any working relationship with that client is gone out the window. Before things go that far there are plenty of steps you can take to get your payments without burning bridges. Step One â" Set Things Up to Reduce Chances of Late Payment The first step comes before you even face a problem. Sorry if youâre already facing a debtor, but for the future itâs good to know how to prevent it. Make sure your contract states with crystal clarity when payments are due and what happens when they are late. Also, draw attention to this with new clients, you can even negotiate on the various factors of it and get them to agree verbally. Once they realize how seriously you take it, theyâre less likely to put you to the end of their list of businesses to pay. If you make it clear to them that you work with a debt collection agency (DCA) such as PJ Consumer Debt Services and that they instantly take over handling any late payments for you, this gets you right to the top of the list. Step Two â" Decide if the Debtâs Worth Your Time Youâve really got to decide if itâs even worth pursuing the payment. For a small debt then your time and effort might be better spent working on your business, and you could put the loss down to experience. Although bear in mind that when you start letting late payers go, it can set a precedent for others. As part of this process, check up on them to see if theyâre solvent. Ask the local court to check the Register of County Court Judgments on them. If they have one, or a debt relief order, or they are already insolvent, then thereâs little chance youâll get your money back. But if they seem to be in decent financial shape; move onto the next step. Step Three â" Communicate Clearly Firstly, give them a gentle reminder. Not need to charge at them all guns blazing the first day they are late. Some clients will forget through disorganization. Secondly, after your warning time is up give them a demand for payment, explaining clearly what they owe, how to pay you, how long theyâve got and what will happen if they donât pay you by a certain date, including interest fees and charges for collection procedures. It helps a great deal if all this was specified in the contract at the beginning, because then they knew it was coming and are less likely to feel bitter towards you. Step Four â" Be Flexible When you talk to them, try to understand their position, and offer to arrange part payments over time. If they have cash flow problems, theyâll appreciate some leniency. But be clear to hold to your new arrangements. Step Five â" Be Persistent and Noisy Donât allow them to ignore you. Itâs likely they have cash flow issues and owe a few companies late payments. You donât want to be the quiet one, which they think hasnât even noticed the late payment. Contact them often, even daily. By calling, email, letter and even visits if itâs convenient. This persistence is hugely powerful in getting people to pay up. Be politely insistent and firm. Step Six â" Threaten to Cut Off Services, and a DCA If you have that kind of a business arrangement, you could threaten to cut off services, which will often sort things out. And the threat of a DCA will also usually push the right buttons. But if that still doesnât work; itâs time to put that threat into action. Step Seven â" Follow Through Cut off services and hand things over to your DCA. That letter through the post is a healthy shock to most debtors. And enough to clean things up. What theyâre thinking is âIâve never used personal branding, and Iâve gotten this far without itâ¦â They nodded their heads during my talk, but I think most of them were dismissing the concept. News flash to the 50+ crowd- studies say that youâre retirement is farther off than you may think and in fact, you may be one of many who are suddenly on the job market after years in the same company and/or industry. If this is you â" or someone you know â" youâll be pleased to know that personal branding is a career management tool. So, who needs personal branding? You do! These days job candidates â" from the boardroom to the mail room need to articulate a promise of value that will convince the prospective employer you can add to the growth of the company. Your personal brand promise needs to be apparent in your resume, your cover letter, your look, your approach, your conversation â"and especially your online presence. Just because youâre getting older doesnt mean that you can not and should not keep up to date with technology. Most recession era job seekers are learning that personal branding helps you be more in control of the direction of your career by increasing your visibility and ability to attract and land target jobs. Mid-Career Personal Branding Tips: Use more than one channel to promote your personal brand. Create a personal, blog, or online resume that prominently features your Personal Branding Statement Tell readers what they will gain by hiring or working with you A picture is worth 1000 words. Use photos and graphic designs that reinforce your verbal message to create memorable. Reinforce your personal brand in all your interactions with others. Mention your key attributes and special qualities in voice mail messages, your email signature, and whenever you speak with current or potential clients face to face. What happens when your brand is tarnished? Many mid-career professionals are more than a little âafraidâ to put themselves out in public so prominently. It is counter-intuitive to those who came up in a corporate culture or team work. Times have changed. And have no fear â" if Donald Trump can survive a brand âhitâ, anyone can. It was recently reported in the Vancouver Sun: Donald Trump, the real estate mogul who has splashed his name on everything from skyscrapers to neckties to bottled water, has suffered a string of recent reversals that threaten to dilute his cachet, say branding experts. His name, which he often licenses to real estate projects in which he has no direct control, has earned him millions. His brand is associated with success and making money. And every time the word bankruptcy appears next to Trump, thats not good, said Allen Adamson, managing director of Landor, a brand consultancy. He can take a few chinks in the armor, but I think hes probably at the limit. On the other hand, failure might not tarnish Trumps image as much as it might seem, said Scott Davis, a partner at Prophet, a branding firm. Trump has some wiggle room because his story exalts the comeback, not just uninterrupted success. Davis said. Hes the guy who bounces back, Davis said.
